Yes, you read correctly. You're breaking the law.
If you are in this section of the site, it is very likely you have downloaded at least one ROM and to clear up all the controversy about the legality of this, i am posting this thread.

DOWNLOADING A ROM IS 100% ILLEGAL!

This also applies to downloading warez (Apz, software) and liscenced anime.

There is NO law which says you can download this. Even if you own an original cartridge and delete it within 24 hours you are still breaking the law. Please don't ask about it in the future.

If you own the catrridge its a thing called "fair use" where u can make a backup copy of it. Incase something happens to the original catridge ..

So if you own the catridge and you dont have a backup unit. It might be okay for you to download the roms for backup sakes..

But in the real world ... nobody cares ... they just download everything they can even if they dont even own a gameboy ! :D

You can CREATE a backup IF you OWN the cartridge. You CANNOT DOWNLOAD it.

also, most companies dont allow you to even make a copy, it depends on their TOS

Amen to that. Or if you dumped the ROM, then it's legal for you to download it, but if someone else dumped it then you can't download.

So you can make 1 backup copy if you own the actual game itself.

No might be's, it's a not. It is not okay for you to download a ROM for backup purposes.

There is no "backup" law...

As a matter of fact, nintendo, sony and microsoft all state that copies are illegal.  Even if you own an original.

Look at their offical sites.  It even states this in the game manuals... if anyone ever bothered to READ those anymore.

So much discussion. What is there even to discuss?

The only way to own a ROM legally is to dump it yourself if the publishers of the game allow backups.
And distributing that backup is also illegal, in case anyone is wondering.

Xplay, I hvae downloaded many ROMs in my time. I never said i hadn't.
This topic was merely here to inform disillusioned people that they are brea\king the law and to stop people talking about those "24 hour" and "original Cartridge" laws that don't actually exist.

24 hours --> Doesn't exists.
If you own the catige, you do have to dump it yourself, for a backup, you are not alowed to use it.

AND Microsoft says, and I quote:
"Do not make any ilegel copy of this product"

Which means, you CAN and ALOWED to back it up for yourself.

And another thing, I got a burned copy of WinXP but it is legel, because of a licence aggrement, so my copy is burned, but legal.
